Tampa LBGTQ+ Family Lawyer

Older Lundy Koch & Martino is proud of marriage equality in Florida. Beginning in January 2015, Florida recognizes the rights of gay and lesbian couples to marry and recognizes same-sex marriages performed in other jurisdictions. The federal government has also acknowledged same-sex marriage rights in the groundbreaking Supreme Court Decision U.S. v. Windsor, which struck down the Defense of Marriage Act (“DOMA”).

Unfortunately, some states have yet to extend these rights to same-sex couples. Consequently, gay, lesbian, bisexual and transgender individuals do not have the same legal protections and allowances as heterosexuals. As a result, issues regarding divorce, custody of children, division of property upon separation, spousal maintenance, and health care issues may be much more difficult for same-sex couples.

Dissolution of Marriage, Civil Unions, and Long-Term Partnerships

LGBT couples who have prenuptial, postnuptial or cohabitation agreements, including contracts for sharing of expenses, tenancy agreements or otherwise documented legal relationships, are in a better position should they decide to terminate their, since they have already discussed and agreed upon most of those issues that would arise upon termination.

However, even if you do have these types of document in place, your partner may still sue you for a division of marital or partnership assets, including any equity acquired in your home during your relationship, any earnings on investments during that time and interest earned on your bank accounts. Our firm can help you resolve all of the following issues:

  • Same-sex divorce
  • Custody and support of children (including biological and nonbiological children)
  • Dissolution of long-term relationships
  • Reallocation of assets
  • Transfer of real estate and other property
  • Same-sex domestic violence

Recently, a number of important legal developments have occurred regarding same-sex marriages. Although the federal government has made a national decision, the laws in many states are still in flux, often making it necessary to combine contract law, estates and trusts, family law, and health care directives in order to create solutions that work for our LGBT clients. Our broad-based experience allows us to apply a wide range of tools to avoid a dispute before it happens, or resolve one that has already developed and to otherwise protect your rights.

At Older Lundy Koch & Martino , we’re poised on the cutting edge of development in this area. We follow cases on a daily basis in order to use new legal precedents to advance our clients’ cases. For many years, we have successfully been involved in such matters as these.
