TIMOTHY C. GARDING is part of the commercial litigation practice group of OLDER LUNDY KOCH & MARTINO.  Assertive in his approach, Tim is a problem solver and regularly represents individuals and businesses in negotiations, dispute resolution, and litigation involving complex real estate transactions, commercial leasing, landlord-tenant law, restrictive covenants, construction defects, land use & zoning, homeowner/condominium associations, commercial and residential foreclosures, title/boundary disputes, and insurance coverage claims.  Tim also handles contested partition actions, including those involving “heirs” property, and routinely represents fiduciaries and beneficiaries in trust and estate litigation.

Timothy C. Garding

Clients turn to Tim for his ability to provide legal counsel on a broad range of commercial and business-related matters.  He has experience working with local governmental bodies in both a representative and adversarial capacity on matters such as code enforcement, wet zoning, variances, vested rights determinations, and permitting/licensing.  Tim also represents clients in state regulatory matters, ranging from assisting with healthcare facility permitting and licensure to defending clients in professional license disciplinary investigations and proceedings.

Tim draws on his litigation experience to advise his business clients on various risk management strategies concerning labor and employment law and an array of other corporate compliance and governance matters. His proactive and collaborative approach allows him to resolve disputes in a way that satisfies his clients’ immediate goals, while also supporting long-term business strategies.

In 2010, Tim received Tampa Bay Business Journal’s Up and Comer Award. He was included on the prestigious annual list of Super Lawyers Rising Stars from 2012 through 2019.  Prior to joining OLDER LUNDY, he was a partner at the law firm of Shumaker, Loop & Kendrick, LLP. 

Involved in the Tampa Bay community, Tim is a longtime supporter of local arts initiatives and has served on various non-profit boards throughout his career.
